Omar Abdullah’s case

Former chief minister of Jammu and Kashmir Omer Abdullah is presently under detention and his sister has challenged the detention after the authorities slapped him with PSA recently. His sister went to Supreme Court and pleaded that her brother should be brought in person to the court and released as the grounds of detention mentioned by the authorities do not hold ground under law.

Recently the case came before the Supreme Court and the administration has filed an affidavit about the dangers being posed by the release of Omer Abdullah and its impact on the overall situation in Kashmir valley.

Jammu and Kashmir administration told the Supreme Court that former Jammu and Kashmir Chief Minister Omar Abdullah has been “very vocal critic” of abrogation of Article 370 and his presence would pose an “imminent threat to public order.”

The administration also objected to the petition filed by Omar Abdullah’s sister challenging his detention under the Jammu and Kashmir Public Safety Act (PSA), 1978.

Talking in details about the dangers being posed by Omer Abdullah, administration has told court that even prior to the decision of the central government; he has been severely opposing such move of the government and can endanger peace and tranquility in Kashmir valley.

The affidavit was filed on the petition of Sara Abdullah Pilot, challenging the detention of former Jammu and Kashmir Chief Minister Omar Abdullah under the Jammu and Kashmir Public Safety Act, 1978.

As the matter is coming up in court again, it has brought a fresh focus on the continues detention of three former chief ministers in Jammu and Kashmir state as they were detained after they were trying to oppose the move of the centre to abrogate article 370.
